Over the last couple of months, Transfolk WA has engaged with the Attorney-General’s Office and the Department of Justice. We’ve been given the opportunity to provide feedback into various aspects of its implementation.
Our understanding is the Department of Justice are still working on the regulations, which will tell us what the process would look like. While we don’t have an exact date, the Gender Reassignment Board’s website tells us that a new process should hopefully be in place by April or May 2025.
For anyone seeking to change their gender marker on their WA birth certificate, there are currently two options:
1. You can go through with the current process
This requires applying to the Gender Reassignment Board where you must provide proof of a “gender reassignment procedure” and evidence of “proper counselling,” along with paying associated fees. More details: https://grb.justice.wa.gov.au/
2. Wait for the new legislation’s process to be implemented (hopefully by May 2025)
This should make the whole process more accessible by removing the current medical requirements and simplifying the application process. We understand this is a personal decision that depends on individual circumstances and urgency.
Once the new Attorney-General has been announced, we will ask for a meeting to discuss the reforms and to continue advocating so the new laws work better for our community.
